1. Acceptance of Terms

By creating an account or using NicheGenPro ("the Service"), you agree to these Terms of Service and our Privacy Policy. If you do not agree to these terms, you may not use the Service. These terms apply to all users, including contributors, browsers, and customers.

2. Description of Service

NicheGenPro provides AI-powered tools for stock photography contributors, including:

  • •Niche Finder — market research for low-competition stock photography niches
  • •Prompt Forge — AI prompt generation for image and video creation tools
  • •Metadata Generator — AI-powered title, keyword, and category generation for stock platforms

3. Account Registration

To use NicheGenPro, you must create an account with a valid email address. You are responsible for maintaining the security of your account and password.

You must not use temporary, disposable, or fake email addresses. Accounts created with fraudulent information may be terminated without notice.

You must be at least 13 years of age to create an account. By registering, you represent that you meet this requirement.

4. Credits and Payments

NicheGenPro operates on a credit system. Credits are purchased through our platform and deducted when you use our tools.

Purchased credits do not expire and remain in your account until used. There are no time limits or subscription requirements.

All purchases are final. We do not offer refunds for purchased credits except in cases of technical errors where credits were incorrectly deducted from your account.

Prices are listed in US Dollars (USD). We reserve the right to change pricing at any time. Price changes will not affect credits already purchased.

5. Acceptable Use

You agree to use NicheGenPro only for lawful purposes. You must not:

✕Create multiple accounts to exploit free credit offers
✕Use automated scripts or bots to abuse the platform
✕Attempt to reverse engineer or bypass our systems
✕Upload content that violates any law or third-party rights
✕Share your account credentials with others
✕Use the Service to generate illegal, harmful, or offensive content
✕Attempt to access other users' accounts or data

6. AI-Generated Content

NicheGenPro uses AI (Google Gemini) to generate content including niche research, prompts, and metadata. You acknowledge that:

  • →AI-generated content may not always be accurate or complete
  • →You are responsible for reviewing and verifying AI outputs before use
  • →We do not guarantee that generated metadata will be accepted by stock platforms
  • →You own the content you create using our generated prompts and metadata

7. Intellectual Property

NicheGenPro and its original content, features, and functionality are owned by NicheGenPro and protected by intellectual property laws.

You retain ownership of any content you upload to our platform. By uploading content, you grant us a limited license to process that content solely for the purpose of providing our Service.

8. Disclaimer of Warranties

NicheGenPro is provided "as is" and "as available" without warranties of any kind. We do not warrant that the Service will be uninterrupted, error-free, or that AI-generated results will meet your expectations. Use of the Service is at your own risk.

9. Limitation of Liability

To the maximum extent permitted by law, NicheGenPro shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the past 12 months.

10. Account Termination

You may delete your account at any time through the Settings page. Upon deletion, your personal data will be removed within 30 days.

We reserve the right to suspend or terminate accounts that violate these Terms of Service, engage in fraudulent activity, or abuse our platform. Terminated accounts will not receive refunds for unused credits.

11. Changes to Terms

We may update these Terms of Service at any time. We will notify you of significant changes by email or through the platform. Continued use of NicheGenPro after changes take effect constitutes your acceptance of the new terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with applicable international law. Any disputes arising from these terms or your use of NicheGenPro shall be resolved through good faith negotiation before pursuing other remedies.
